Board of Supervisors Minutes - January 9, 2010
Present: Larry Gibbs, Gary Bowden, Ron McCartney
The Board met with the County Engineer regarding the Secondary Road Program project budget for FY 2013.
After discussion regarding the contribution by the City of McGregor to the Eagle Drive project, a motion was made by Gibbs, seconded by McCartney, to approve resolution # 3-2012 regarding an amendment to McGregor TIF. Ayes: Gibbs, McCartney, Bowden
RESOLUTION # 3-2012
WHEREAS, the City of McGregor, Iowa (the “City”) has begun the process of adding territory to its Consolidated McGregor Urban Renewal Area (the “Urban Renewal Area”), pursuant to Chapter 403 of the Code of Iowa, to add additional property; and
WHEREAS, a portion of the property which is proposed to be added to the Urban Renewal Area is located outside the city limits, such property being described on Exhibit A hereto (the “Additional Property”); and
WHEREAS, in accordance with paragraph 4 of Section 403.17 of the Code of Iowa, a city may exercise urban renewal power with respect to property which is located outside but within two miles of the boundary of that city, but only if the city obtains the consent of the county within which such property is located; and
WHEREAS, the City Council of the City has requested that the Board of Supervisors of Clayton County adopt this resolution giving its consent that the City may exercise urban renewal powers with respect to the portions of the Additional Property lying within two miles of the incorporated city limits;
NOW, THEREFORE, it is hereby resolved by the Board of Supervisors of Clayton County, Iowa, as follows:
Section 1. The Clayton County Board of Supervisors hereby gives its consent that the City of McGregor may exercise urban renewal powers pursuant to Chapter 403 of the Coder of Iowa with respect to the Additional Property.
Section 2. This Resolution shall be deemed to meet the statutory requirements of paragraph 4 of Section 403.17 of the Code of Iowa and shall be effective immediately following its approval and execution.
Legal Description- McGregor Urban Renewal Area-2012 Addition
Certain real property in the City of McGregor, Clayton County, State of Iowa more particularly described as follows: The public right-of-way of Eagle Drive from the intersection of Cemetery Rd./138th St. west to the intersection of US Highway 18 (approximately one mile).
Passed and approved this 9th day of January, 2012.
Motion by McCartney, seconded by Gibbs, to appoint Fran Zichal and Shirley Christianson to the Northland Agency on Aging Board for a term ending December 31, 2014. Ayes: Gibbs, McCartney, Bowden
Motion by Gibbs, seconded by McCartney, to appoint Kevin Clefisch to the County Compensation Board to replace John Youngblut who became ineligible being elected as the Mayor of Clayton. The term runs until June 30, 2013. Ayes: Gibbs, McCartney, Bowden
The Board received notification that the following appointments to represent the public were made to the County Compensation Board:
Appointed by the County Auditor-Steve Clausen, CPA , term ending June 30, 2015.
Appointed by the County Attorney-Steve McCorkindale, attorney, term ending June 30, 2015.
Appointed by the County Sheriff-Gary Willie, term ending June 30, 2015.
