Meeting of the Board of Supervisors at their office, 200 E. Bridge St, Elkader, IA. Present: Robert Walke, Neil Meyer, Larry Gibbs
In accordance with Chapter 331.904 of the Code of Iowa, Sue Meyer, Clayton County Recorder, certified a percentage change for Debra Tyer, Deputy Recorder, to 55% of the County Recorder’s salary effective on the payroll for January, 2006.
Motion by Walke, seconded by Meyer, to approve resolution #1-2006 to advertise for bids on project L2011(5) RCB Culvert at the intersection of 390th St and Crystal Road in Clayton County. Ayes: Walke, Meyer, Gibbs RESOLUTION # 1-2006 BE IT HEREBY RESOLVED by the Board of Supervisors of Clayton County, Iowa, that the County Auditor be directed to advertise for bids on the following project:
L2011(5) RCB Culvert located on the section line of 29 and 32, T91N, R5W, Lodomillo Township at the intersection of 390th and Crystal Road, Clayton County.
Bids will be received until 11:00 A.M. February 15, 2006 at the office of the Clayton County Auditor in the Courthouse in Elkader, Iowa.
A public hearing was conducted on a proposed zoning change and final plat approval for Highland Bluffs Golf and Waterplay Resort. A public hearing was held on December 21, 2005, which there was confusion about the time of the hearing. This public hearing is being held after publication of notice to correct that confusion. Mike Oberbroeckling stated the decision of the Planning and Zoning Commission. Larry Stone expressed his concern regarding the handling of sewage that it not be dumped into Sny Magill Creek. The Board explained that the DNR will have control of the wastewater discharged. Stan Thomas expressed his concern that the DNR is not taking care of the discharge water from the development. He showed a quart jar of water that had silt contained in it he sampled from the stream that runs on his property. He showed pictures of his property with water coming through it last summer. The Board explained that any time an acre or more of ground is disturbed for development the DNR regulates the site for stormwater discharge. Motion by Walke, seconded by Meyer, to approve the second reading of the zoning change and final plat approval of Highland Bluffs Golf & Waterplay Resort. The safety issue is to be addressed with the County Engineer to be contacted to study the problem and suggest where a crossing should be placed. An overpass or underpass is not required unless required sight distance is not available. Ayes: Walke, Meyer, Gibbs

Accepting the final plat of Highland Bluffs Golf & Waterplay Resort
WHEREAS, there has been submitted to the Board of Supervisors of Clayton County, Iowa, a plat of real property hereinafter designated as Highland Bluffs Golf & Waterplay Resort and described as parts of Section 30 and 31, T95N, R3Wof the 5 th P.M. and section 36, T95N, R4W, of the 5 th P.M., located in Clayton County, Iowa,
WHEREAS, Freeman Michaels, John & Alanna Freeman as owners of said real property, have executed and acknowledged an instrument consenting to said plat,
WHEREAS, it appears that said plat complies with all requirements of Chapters 354 and 355 of the Code of Iowa,
WHEREAS, the Clayton County Planning and Zoning Commission has recommended approval of said subdivision, affirming that it has complied with all the regulations of Clayton County, Iowa,
THEREFORE BE IT RESOLVED by the Clayton County Board of Supervisors that the Board approves as an official subdivision, the plat of real property to be known as parts of Section 30 and 31, T95N, R3Wof the 5 th P.M. and section 36, T95N, R4W, of the 5 th P.M., located in Clayton County, Iowa, (approximately 376.57 acres) situated in Clayton County, Iowa, and described as: parts of Section 30 and 31, T95N, R3Wof the 5 th P.M. and section 36, T95N, R4W, of the 5 th P.M., located in Clayton County, Iowa,
