Present:  Robert Walke, Neil Meyer, Larry Gibbs

 

The board approved claims for payment.

 

Tim Engelhardt, Conservation Director, and Rafe Koopman, County Engineer, were present at the meeting to discuss the adoption of the Clayton County Motor Vehicle Operators Policy.  Motion by Meyer, seconded by Walke, to adopt the Clayton County Motor Vehicle Operators Policy.  Ayes:  Walke, Meyer, Gibbs

 

CLAYTON COUNTY

MOTOR VEHICLE OPERATORS POLICY

 

PURPOSE

 

The safety and well being of our employees is of critical importance to Clayton County. We therefore each have a responsibility to not only protect ourselves when on the road but also should do our part to protect those around us.

 

SCOPE

 

This policy applies to all Clayton County employees who operate motor vehicles for county business. Whenever the provisions of this policy are in conflict with the Iowa Code, then provisions of the Iowa Code will prevail.

 

MINIMUM QUALIFICATIONS

 

1.   Personal vehicles may be used for official Clayton County business with prior approval.  Employees using their personal vehicles will be reimbursed at the prevailing rate.

 

2.   All employees whose duties require the operation of a Clayton County-owned motor vehicle or who operate a privately owned motor vehicle while conducting Clayton County business as a part of their employment must posses a valid state driver's license and a safe-driving record.

 

3.   Employees who regularly operate vehicles on Clayton County business shall submit to a motor vehicle record (MRV) review prior to employment and thereafter on a regular basis.  If the MVR review indicates violations in excess of the recommended guidelines, the applicant or employee may be required (at Clayton County's discretion) to complete defensive driving training based upon the seriousness of the violations.  If a disability or health-related reason caused the adverse driving record, the employer will consider such information and may use such information in making decisions.

 

4.   If during the course of employment, an employee exhibits a disregard for acceptable safe-driving procedures, Clayton County may deny future authorization to operate a vehicle while representing Clayton County.

 

5.   Any employee who operates a privately owned vehicle to conduct Clayton County business is required to maintain automobile liability insurance coverage's on their privately owned vehicle of at least $100,000 and in accordance with the State of Iowa liability recommendations.  Employees who do not maintain minimum liability coverage will not be allowed to operate their privately owned vehicle for Clayton County business.

 

6.   Any employee performing work which requires the operation of a Clayton County vehicle or private vehicle on Clayton County business is required to report to the employee's supervisor or risk management director if his or her license is allowed to expire, is suspended, or revoked. Any employee who fails to report such information is subject to disciplinary action.

 

SAFETY

  1. All employees shall wear seat belts at all time while in a moving vehicle being used for county business according to all applicable laws.

  2. Use of handheld cell phones, whether personal or business-owned, while behind the wheel of a moving vehicle being used on county business is strictly prohibited.

  3. Although use of cell phones under any circumstances is strongly discouraged while driving, the use of hands-free technology may be warranted in unusual or emergency circumstances.

  4. Engaging in other distracting activities including, but not limited to, eating, putting on makeup, reading or changing radio stations or music, is also strongly discouraged while driving, even when in slow-moving traffic.

  5. Use of alcohol, drugs or other substances, including certain over-the-counter cold or allergy medications that in any way impair driving ability, is prohibited.

  6. All employees shall follow all driving laws and safety rules such as adherence to posted speed limits and directional signs, use of turn signals and avoidance of confrontational or offensive behavior while driving.

  7. Employees should never allow anyone to ride in any part of the vehicle not specifically intended for passenger use and/or any seat that does not include a working seat belt.

  8. Employees who drive commercial vehicles or who are otherwise subject to separate rules and regulations such as those dictated by state or federal law are also expected to adhere to all policies and regulations associated with the appropriate law or regulation that applies.

  9. Employees must promptly report any accidents to local law enforcement as well as to the county in accordance with established procedures.

  10. Employees must promptly report any moving or parking violations received while driving on county business and/or in county vehicles.

  11. Employees must promptly report any deficiencies or needed repairs with county vehicles.

  12. Failure to adhere to these procedures may result in disciplinary action per county policy.

REQUIREMENTS

  1. All employees operating motorized vehicles on Clayton County business shall possess a current, valid Driver's license of the appropriate type.

  2. All employees who are required to operate their private vehicles to conduct Clayton County business shall provide verification of insurance to meet the recommended liability limits.

  3. All employees are required to submit to a motor vehicle records review initially and on a regular basis.

RECOMMENDED MOTOR VEHICLE RECORD (MVR) GUIDELINES

  1. No more than two convictions for moving traffic violations within any 12-month period

  2. No more than two moving traffic violations that contribute to accident within any 12‑month period.

  3. Conviction of any traffic violation that is defined as serious by Iowa Code.

Employees who are convicted for moving traffic violations equal to or exceeding the recommended guidelines may be subject to personnel action to include defensive driving courses or suspension of Clayton County driving authorization.

 

Clayton County's Board of Supervisors may require employees who drive on Clayton County business to attend driver's training whenever the aforementioned determines the training to be necessary, even though guidelines have not been exceeded.

 

Motion by Walke, seconded by Meyer, to approve an agreement for the provision of limited professional services with TeKippe Engineering, P.C. regarding the wastewater treatment plant for Scenic Acres and Clayton County Law Enforcement Center.  Ayes:  Walke, Meyer, Gibbs
