Meeting of the Board of Supervisors at their office, 200 E. Bridge St., Elkader, IA
Present: Larry Gibbs, Wayne Bockenstedt, Randy Keehner

The board canvassed the special election held for the MFL-Marmac Community School with the following results:
PUBLIC MEASURE A
Shall the following public measure be adopted?

Shall the Board of Directors of the MFL MarMac Community School District be authorized for a period of ten (10) years to levy and impose a physical plant and equipment tax of not exceeding one dollar and thirty-four cents ($1.34) per $1,000 of assessed valuation, and be authorized annually, in combination, to levy a physical plant and equipment property tax with the levy of property taxes for collection commencing in the fiscal year ending June 30, 2013, and to impose a physical plant and equipment income surtax upon each individual income taxpayer resident in the school district on December 31 for each calendar year commencing with calendar year 2013, or each year thereafter (the percent of income tax not to exceed four percent (4%) determined by the Board of Directors each year) to be used for the purposes set forth in the full ballot?


MFL MarMac Community School District may use Physical Plant and Equipment Levy (PPEL) funds for the following purposes:


1) Improvement of grounds, which includes grading, landscaping, paving, seeding, planting of shrubs and trees; constructing sidewalks, roadways, retaining walls, sewers and storm drains, and installing hydrants; surfacing and soil treatment of athletic fields and tennis courts; exterior lighting, including athletic fields and tennis courts; furnishing and installing flagpoles, gateways, fences, and underground storage tanks which are not parts of building service systems; demolition work; and special assessments against the school district for public improvements, as defined in Iowa Code 384.37.
 

2) Purchase, lease or lease-purchase of single unit of equipment or technology exceeding $500 in value.
 

3) Asbestos projects. (279.52)
 

4) Purchase and improvement of grounds, including the legal cost relating to the property.
 

5) Acquisition, costs of surveys of the property, costs of relocation assistance under state and federal law, and other costs incidental to property acquisition.
 

6) Payment of debts contracted for the erection or construction of schoolhouses or buildings, not including interest on bonds.
 

7) Repairing, remodeling, reconstruction, improving or expanding the schoolhouses or buildings and additions to existing schoolhouses.
 

8) Expenditures for energy conservation.
 

9) The rental of facilities under Chapter 28E.
 

10) Purchase of transportation equipment for transporting students.
 

The results were 229 “Yes” votes and 59 “No” votes thus Public Measure A
passed.

PUBLIC MEASURE B
Shall the following public measure be adopted?

Summary: To adopt a revenue purpose statement describing the use of money from the penny sales and services tax for schools received by the MFL MarMac Community School District.
In the MFL MarMac Community School District, the following revenue purpose statement, which specifies the use of sales and services tax funds from the secure an advanced vision for education fund for school infrastructure (penny sales and services tax for schools) shall be adopted:
Money received by the MFL MarMac Community School District from the State of Iowa secure an advanced vision for education fund may be spent for any one of the following purposes:


1) To provide funds for property tax relief.


2) To pay off the remaining balance on the Fine Arts addition constructed in 2003.
 

3) To purchase cutting-edge technology and technology-related equipment for students.
 

4) To implement energy conservation measures.
 

5) To purchase an energy-efficient boiler system to replace the Circa-1960 system in the K-3/9-12 building.
 

6) To consider purchase and use in the following other areas allowed by law:
 

To provide funds to build and furnish a new school building or buildings; to build and furnish addition(s) to school buildings in the District; to remodel, repair, expand and improve the school buildings in the District; to purchase and improve grounds; for demolition work; to furnish and equip District facilities.
 

To provide funds for the purchase, lease, or lease-purchase of buildings or equipment (including transportation and recreation equipment) as authorized by law, sharing or rental of facilities, procuring or acquisition of libraries, or opening roads to schoolhouses or buildings.
 

To provide funds for emergency repairs to respond to natural disasters, such as fire, wind damage, flood; unanticipated mechanical, plumbing, structural, roof, electrical system failures; environmental remediation; or to respond to changes in demographics that require construction of additions or improvements to school buildings or new school buildings.
 

To provide funds to establish and maintain public recreation places and playgrounds;

provide for supervision and instruction for recreational activities; or for community education purposes; and other authorized expenditures and purposes as now or hereafter permitted by law and designated by the MFL MarMac Community School District.
 

To provide funds for the payment of principal and interest or retirement of general obligation bonds issued for school infrastructure purposes, energy improvement loans, loan agreements authorized by Iowa Code section 297.36, sales, service and use-tax revenue bonds issued under Iowa Code 423E.5.
 

The results were 240 “Yes” votes and 46 “No” votes thus Public Measure B
passed.
