Meeting of the Board of Supervisors at their office, 200 E. Bridge St,
Elkader, IA
Present: Larry Gibbs, Wayne Bockenstedt, Randy Keehner
Larry Gibbs was elected Chairman and Wayne Bockenstedt was elected
Vice-Chairman.
The board approved claims for payment.
The board members will serve on the following boards and commissions:

Motion by Bockenstedt, seconded by Keehner, to set the mileage
reimbursement rate at 32 cents per mile for the year 2010. Ayes: Gibbs,
Bockenstedt, Keehner
Motion by Keehner, seconded by Bockenstedt, to acknowledge the following
designated holidays for 2010:

Motion by Keehner, seconded by Bockenstedt, to designate as official
county newspapers for 2010 the Clayton County Register, Guttenberg Press
and The Outlook. Ayes: Gibbs, Bockenstedt, Keehner
Motion by Bockenstedt, seconded by Keehner, to approve resolution
#1-2010 regarding construction evaluation for animal confinement
buildings (Master Matrix). Ayes: Gibbs, Bockenstedt, Keehner
RESOLUTION # 1-2010
CONSTRUCTION EVALUATION RESOLUTION
WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board
of supervisors wishes to adopt a “construction evaluation resolution”
relating to the construction of a confinement feeding operation
structure; and
WHEREAS, only counties that have adopted a construction evaluation
resolution can submit to the Department of Natural Resources (DNR) an
adopted recommendation to approve or disapprove a construction permit
application regarding a proposed confinement feeding operation
structure; and
WHEREAS, only counties that have adopted a construction evaluation
resolution and submitted an adopted recommendation may contest the DNR’s
decision regarding a specific application; and
WHEREAS, by adopting a construction evaluation resolution the board of
supervisors agrees to evaluate every construction permit application for
a proposed confinement feeding operation structure received by the board
of supervisors between February 1, 2010 and January 31, 2011 and submit
an adopted recommendation regarding that application to the DNR; and
WHEREAS, the board of supervisors must conduct an evaluation of every
construction permit application using the master matrix created in Iowa
Code section 459.305, but the board’s recommendation to the DNR may be
based on the final score on the master matrix or may be based on reasons
other than the final score on the master matrix;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF CLAYTON
COUNTY that the Board of Supervisors hereby adopts this construction
evaluation resolution pursuant to Iowa Code section 459.304(3).
Alan Ruff and his wife discussed the situation on Ivy Road regarding a
letter to be sent to Greg Koether and the board’s ability to limit
access to the road that is classified as Class C. Snowmobilers access
was discussed. The Ruffs do not want snowmobilers on the road. The
County Engineer recommended that the board change the road to Class B as
the status of Class C is not working out for the adjoining landowners.
Vacating the road was discussed by the Ruffs and the County Engineer
which is also an option if Schoultes would agree. The Engineer stated
that the county has never nor do we want to in the future maintain the
locks on gates on Class C roads with multiple landowners on it.
The Engineer stated that snowmobiles are granted access to use Class C
roads
with permission of the adjoining land owners. Mud runners are not by
state law. The Ruffs stated that the problem is that the snowmobilers
are leaving the gate open. The board stated that a ramp could be
installed to solve that problem or reclassify the road to Class B. The
Ruffs want the county to have the adjoining landowners put a lock on the
gate. The Engineer stated that the situation is such that there are too
many landowners for the road to be classified a Class C road.
Motion by Bockenstedt, seconded by Keehner, to direct the County
Engineer to proceed to reclassify the portion of Ivy Road that is
classified as Class C to a Class B. Ayes: Gibbs, Bockenstedt, Keehner

December 23, 2009 and January 6, 2010. Ayes: Gibbs, Bockenstedt, Keehner
